CONSUMER HEALTH DATA PRIVACY POLICY

Dorian Marie LLC (“Dorian Marie,” “we,” “us,” or “our”) respects the privacy of personal health information and is committed to handling consumer health data responsibly.

 

This Consumer Health Data Privacy Policy applies to consumer health data collected by Dorian Marie LLC in connection with our websites, consultation and professional services, educational services, forms, communications, and other services or interactions where consumer health data may be collected or processed.

This policy is intended to provide the disclosures required under the Washington My Health My Data Act, Chapter 19.373 RCW.

This policy is separate from our general Privacy Policy, which governs the broader collection and use of personal information by Dorian Marie LLC.

1. What Is Consumer Health Data?

 

Under Washington law, “consumer health data” generally means personal information that is linked or reasonably linkable to a consumer and that identifies the consumer’s past, present, or future physical or mental health status.

Depending on the information voluntarily provided and the services requested, consumer health data may include information relating to:

  • Scalp or hair-related symptoms, conditions, concerns, or changes

  • Information about an individual's physical health status that is relevant to a requested consultation or service

  • Health-related symptoms, observations, measurements, or descriptions

  • Information about diagnoses, treatments, procedures, or medications when voluntarily provided in connection with a requested service

  • Photographs, images, or other information relating to a person's scalp, hair, or physical condition when voluntarily submitted for a consultation or service

  • Other information that identifies or can reasonably be associated with an individual's health status

 

Not all information submitted to Dorian Marie LLC constitutes consumer health data. Information is treated as consumer health data when it falls within the applicable definition under Washington law.

2. Categories of Consumer Health Data We May Collect

 

Depending on the service requested and the information voluntarily provided, Dorian Marie LLC may collect the following categories of consumer health data:

  • Health-related concerns and symptoms: Information about scalp, hair, skin, or other physical concerns relevant to a requested consultation or service.

  • Health conditions and diagnoses: Information about conditions or diagnoses that a consumer voluntarily provides when relevant to a requested service.

  • Treatments, procedures, or medications: Information about treatments, procedures, or prescribed medications that a consumer voluntarily provides when relevant to a requested service.

  • Photographs and images: Photographs or other images voluntarily submitted for the purpose of evaluating or discussing a scalp, hair, or other physical concern.

  • Measurements or observations: Health-related measurements, observations, or other information voluntarily provided or collected as part of a requested consultation or service.

  • Other health-related information: Other information that identifies or can reasonably be associated with a consumer’s physical or mental health status and that is voluntarily provided or collected as necessary to provide a requested service.

 

Dorian Marie LLC does not intentionally request consumer health data that is unnecessary for the service being provided.

3. How We Collect Consumer Health Data

 

Consumer health data may be collected directly from the consumer through:

  • Consultation or service intake forms

  • Questionnaires and assessment forms

  • Appointment or service communications

  • Emails, messages, or other communications with Dorian Marie LLC

  • Photographs, images, or documents voluntarily submitted by the consumer

  • Information voluntarily provided during a consultation or other service

  • Educational or professional service forms when health-related information is voluntarily included

  • Other forms or methods through which a consumer voluntarily provides information to us

 

Consumer health data may also be processed through service providers that provide technology or operational services on our behalf, such as website hosting, form processing, scheduling, customer management, secure data storage, communications, or other services necessary to operate our business.

4. Why We Collect and Use Consumer Health Data

 

Dorian Marie LLC may collect and use consumer health data for the following purposes:

  • To provide consultations or other services requested by the consumer

  • To understand the information a consumer voluntarily provides regarding a scalp, hair, or other health-related concern

  • To prepare for and conduct a requested consultation or service

  • To communicate with the consumer regarding a requested service

  • To provide recommendations, educational information, or professional guidance within the scope of the service requested

  • To document and administer services provided

  • To respond to questions or requests from consumers

  • To schedule, administer, and manage appointments and services

  • To maintain appropriate business records

  • To protect the security and integrity of our systems and services

  • To comply with applicable legal obligations

  • For other purposes specifically disclosed to the consumer at or before the time the information is collected

 

Dorian Marie LLC does not use consumer health data for purposes materially different from those disclosed in this policy without first providing the disclosures and obtaining consent where required by applicable law.

5. Our Services Are Not Healthcare Services

 

Dorian Marie LLC provides educational, consulting, professional, and hair and scalp-related services. Dorian Marie LLC is not a healthcare provider, does not operate as a medical practice, and does not provide medical diagnosis or treatment.

Information provided during a consultation or other service does not establish a physician-patient, healthcare provider-patient, or similar medical relationship.

Consumers should seek advice from an appropriately licensed healthcare professional for medical diagnosis, treatment, or other healthcare needs.

6. Sources of Consumer Health Data

 

Dorian Marie LLC may obtain consumer health data from the following categories of sources:

  • Directly from the consumer: Information voluntarily submitted through consultation forms, questionnaires, emails, messages, photographs, documents, or during a requested service.

  • Through service-related communications: Information voluntarily provided by a consumer while communicating with Dorian Marie LLC about a requested consultation or service.

  • Through service providers: Information processed through third-party service providers that facilitate forms, scheduling, communications, data storage, customer management, or other business functions on behalf of Dorian Marie LLC.

  • From other sources at the consumer's direction: Information that a consumer specifically directs or authorizes us to receive in connection with a requested service.

 

Dorian Marie LLC does not knowingly obtain consumer health data from third-party sources for purposes unrelated to the services or interactions described in this policy.

7. When We Share Consumer Health Data

 

Dorian Marie LLC may share consumer health data only as permitted by applicable law.

 

Depending on the service and the information involved, consumer health data may be shared with the following categories of third parties:

  • Technology and service providers that provide website hosting, forms, scheduling, customer management, communications, data storage, security, or similar business services

  • Professional service providers that assist Dorian Marie LLC with business operations where access to information is necessary for the services they provide

  • Service providers necessary to fulfill a consumer-requested service

  • Government authorities or other parties when disclosure is required by law, legal process, or a valid legal obligation

  • Other parties when the consumer has provided the required consent or otherwise authorized the disclosure

 

Dorian Marie LLC does not sell consumer health data.

 

Dorian Marie LLC does not share consumer health data with third parties for their own independent marketing purposes unless separately disclosed to the consumer and permitted by applicable law.

8. Third-Party Service Providers

 

Dorian Marie LLC uses third-party technology and service providers to operate portions of our business. Depending on the service involved, these providers may process information on our behalf.

 

Categories of service providers may include:

  • Website and ecommerce providers

  • Form and questionnaire providers

  • Scheduling and appointment platforms

  • Customer relationship management and communication platforms

  • Email and messaging providers

  • Cloud storage and data management providers

  • Learning and educational platforms

  • Payment and transaction service providers

9. Consumer Health Data Rights

 

Washington law provides consumers with certain rights concerning their consumer health data.

 

Subject to applicable legal exceptions, consumers may request: Confirmation and Access

You may request confirmation of whether Dorian Marie LLC is collecting, sharing, or selling consumer health data concerning you and may request access to that data.

You may also request information regarding third parties and affiliates with whom your consumer health data has been shared or sold, as applicable.

Withdrawal of Consent

You may withdraw consent to our collection or sharing of your consumer health data where consent is the legal basis for that collection or sharing.

Withdrawal of consent does not affect processing that was lawfully conducted before consent was withdrawn.

Deletion

You may request that Dorian Marie LLC delete consumer health data concerning you, subject to applicable legal exceptions.

A deletion request may apply to consumer health data maintained in our systems, including applicable archived or backup systems, as required by law.

Please include enough information for us to understand your request and verify your identity. We may request additional information reasonably necessary to authenticate a request and protect against unauthorized access to consumer information.

You do not need to create a new account solely to exercise your consumer health data rights.

We will respond to qualifying consumer health data requests without undue delay and generally within 45 days of receiving the request. When reasonably necessary due to the complexity or number of requests, we may extend the response period by an additional 45 days, as permitted by Washington law. If an extension is necessary, we will notify you within the initial 45-day period and explain the reason for the extension.

Requests are generally provided without charge up to twice per year. If a request is manifestly unfounded, excessive, or repetitive, applicable law may permit us to charge a reasonable administrative fee or decline to act on the request.

11. Appeals

If Dorian Marie LLC declines to take action on a consumer health data request, you may appeal that decision by contacting us using the same contact information above.

Please identify the original request and explain why you believe the decision should be reconsidered.

We will review the appeal and provide a written response within 45 days of receiving the appeal, including an explanation of the decision.

If an appeal is denied, we will provide information regarding how to contact the Washington State Attorney General to submit a complaint, as required by applicable law.

12. Sale of Consumer Health Data

Dorian Marie LLC does not sell consumer health data.

If our practices regarding the sale of consumer health data ever change, we will comply with applicable Washington law, including obtaining a valid authorization before selling or offering to sell consumer health data when required.

13. Data Security

 

Dorian Marie LLC maintains reasonable administrative, technical, and physical safeguards designed to protect consumer health data from unauthorized access, acquisition, use, or disclosure.

 

Because no method of electronic storage or transmission can be guaranteed to be completely secure, we cannot guarantee absolute security of information.

14. Changes to This Policy

We may update this Consumer Health Data Privacy Policy from time to time to reflect changes in our services, data practices, technology, or applicable law.

If we intend to collect, use, or share additional categories of consumer health data or use consumer health data for additional purposes not disclosed in this policy, we will provide the disclosures and obtain affirmative consent where required by applicable law before doing so.

The “Last Updated” date at the beginning of this policy indicates when this policy was most recently revised.
